Terms of Service

These Terms of Service ("Terms") govern your access to and use of VaultedWatch.com (the "Site") and your purchase of any products offered by [Vaulted Watch, LLC], a Kansas limited liability company ("Vaulted," "we," "us," or "our").

By accessing the Site, subscribing to our publications, or purchasing a watch from Vaulted, you agree to these Terms and to our Inspection & Returns Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Site or purchase from Vaulted.

1. Eligibility

You must be at least eighteen (18) years of age and capable of forming a binding contract to purchase from Vaulted. By placing an order, you represent that you meet these requirements.

2. Products and Listings

Every watch offered by Vaulted is inspected, authenticated, photographed, and described before sale. Each listing — including its written description, condition report, and photographs — forms the complete description of the item. Photographs are part of the description; buyers are expected to review them carefully before purchasing.

All watches are vintage or pre-owned unless expressly stated otherwise. Watches are one-of-a-kind items and are offered subject to availability and prior sale. Vaulted reserves the right to withdraw any listing at any time before order acceptance.

3. Orders, Acceptance, and Payment

An order placed through the Site, or a purchase agreed by wire transfer or other direct arrangement, constitutes an offer to purchase. Vaulted may accept or decline any order in its sole discretion, including where fraud, payment risk, or a listing error is suspected. An order is accepted only when Vaulted confirms acceptance in writing or ships the watch, whichever occurs first.

Payment must be received in full before shipment. Accepted payment methods are stated at checkout or agreed in writing. For wire transfers, the buyer is responsible for all sending and intermediary bank fees; the amount received by Vaulted must equal the invoiced amount.

4. Pricing Errors

Despite our care, a listing may occasionally contain a pricing or typographical error. Vaulted reserves the right to cancel any order arising from a material pricing or description error, whether or not the order has been confirmed, provided the watch has not yet shipped. If an order is cancelled under this section, Vaulted will promptly refund any payment received in full.

5. Not Investment, Appraisal, or Professional Advice

Vaulted publishes essays, commentary, valuations, and opinions about watches, collecting, and the watch market. This content is editorial in nature. It does not constitute investment advice, financial advice, an appraisal, or a guarantee of value, and it should not be relied upon as any of those things.

Watches are collectibles. Their market value may rise or fall, and past prices are not an indication of future value. Vaulted makes no representation that any watch will appreciate, hold its value, or be resellable at any particular price.

6. Authenticity and Condition

Authenticity and condition matters are governed by the Inspection & Returns Policy, including the Authenticity Guarantee, the Five Business Day Inspection Period, the Condition Disclosure, and the Warranty Disclaimer stated there. In the event of any conflict between these Terms and the Inspection & Returns Policy regarding a purchased watch, the Inspection & Returns Policy controls.

7. Intellectual Property

All content on the Site and in Vaulted's publications — including essays, product descriptions, condition reports, photographs, videos, graphics, logos, and the Vaulted name and marks — is the property of Vaulted or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive license to access and view Site content for personal, non-commercial use. You may not reproduce, distribute, republish, scrape, or use any Vaulted content — including listing photographs and written descriptions — for any commercial purpose, including in your own listings or resale of a watch purchased from Vaulted, without Vaulted's prior written consent. Purchasing a watch conveys ownership of the watch; it does not convey any rights in the photographs, essays, or descriptions associated with it.

8. Acceptable Use

You agree not to use the Site to violate any law; to interfere with the Site's operation or security; to misrepresent your identity in connection with a purchase or claim; or to submit fraudulent orders, claims, or chargebacks. Vaulted reserves the right to refuse service and to pursue all available remedies for fraudulent or abusive conduct.

9. Third-Party Platforms and Links

Vaulted also sells through third-party marketplaces, including Chrono24, eBay, and Facebook Marketplace. Transactions completed on those platforms remain subject to the buyer-protection and dispute-resolution procedures of those platforms, as stated in the Inspection & Returns Policy. The Site may contain links to third-party websites and services; Vaulted is not responsible for their content or practices.

10. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect and use information. By using the Site, you consent to those practices.

11. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranty of any kind, express or implied. Vaulted does not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Warranties relating to purchased watches are governed exclusively by the Inspection & Returns Policy; except as expressly stated there, all watches are sold as-is, with no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

12. Limitation of Liability

To the fullest extent permitted by law, Vaulted's total liability arising out of or relating to these Terms, the Site, or any purchase shall not exceed the amount actually paid by the buyer for the watch giving rise to the claim (or, for claims not relating to a purchase, one hundred U.S. dollars). In no event shall Vaulted be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of value, lost profits, or loss of use, even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless Vaulted and its owners, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site or its content, or your violation of any law or third-party right.

14. Governing Law and Disputes

These Terms and every sale made directly by Vaulted are governed by the laws of the State of Kansas, without regard to its conflict-of-laws principles. Any legal action or proceeding arising out of or relating to these Terms or a purchase from Vaulted shall be brought exclusively in the state or federal courts located in [Johnson] County, Kansas, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply to any sale made by Vaulted.

15. Changes to These Terms

Vaulted may revise these Terms from time to time. The version in effect at the time of your purchase governs that purchase. Continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms.

16. General Provisions

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Vaulted's failure to enforce any provision is not a waiver of it. You may not assign these Terms without Vaulted's written consent. These Terms, together with the Inspection & Returns Policy and the Privacy Policy, constitute the entire agreement between you and Vaulted regarding the Site and any purchase, and supersede any prior understandings.

18. SMS Messaging Terms

Vaulted Watch LLC may send text messages in connection with watch-selling, trade, consignment, archived-watch, waitlist, and customer-care requests when you expressly request SMS contact. If you separately select the optional SMS marketing checkbox, we may also send occasional marketing messages about watches, availability, and related services. Marketing consent is not required to submit an inquiry or make a purchase.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out. Reply HELP for help, email jeff@vaultedwatch.com, or call +1 816-805-6338. After you reply STOP, we may send one final confirmation message. Carriers are not liable for delayed or undelivered messages. Your participation is subject to our Privacy Policy.
